Compliance with GDPR
a) Data must be processed lawfully, fairly and in a transparent manner in relation to individuals.
Framework Marketing has a legitimate interest to process personal data relating to decision-makers and budget holders in businesses in the EU for direct marketing services. The data is gathered indirectly from publicly available sources and directly from the companies concerned.
b) Data must be collected for specified, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes; further processing for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes shall not be considered to be incompatible with the initial purposes.
Data is collected for the purpose of compiling a database of business contacts to be used by Framework Marketing and its clients for business-to-business marketing. The GDPR states, ‘the processing of personal data for direct marketing purposes may be regarded as carried out for a legitimate interest.’ If any Third Party products and/or services are used by an individual after receiving direct marketing through Framework Marketing, please note that their own terms and privacy policies will govern your use of those products and/or services.
(c) Data must be adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed.
The data collected is limited to names of senior managers and directors specified at source as a contact for the company, their job titles, company addresses, company landline or mobile telephone numbers and corporate email addresses.
(d) Data must be accurate and, where necessary, kept up to date; every reasonable step must be taken to ensure that personal data that are inaccurate, having regard to the purposes for which they are processed, are erased or rectified without delay.
Framework Marketing checks all information using email marketing analysis. If any email addresses bounce or any responses are received stating that members of staff no longer work at their respective companies, their data is removed in a reasonable time, but always before the data is used again. This ensures that all data is accurate and up-to-date. The individual also always has the option to update their details when receiving any communication through Framework Marketing to keep all aspects up-to-date and to shift the balance of data control towards the individual.
(e) Data must be kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed; personal data may be stored for longer periods insofar as the personal data will be processed solely for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes subject to implementation of the appropriate technical and organisational measures required by the GDPR in order to safeguard the rights and freedoms of individuals.
If a person leaves their role or unsubscribes/opts out of receiving further communication from Framework Marketing or carefully selected third parties, their name and contact details are deleted from the applicable database. Two options to unsubscribe are given at the bottom of every marketing email; one to unsubscribe from all marketing emails from Framework Marketing and its carefully selected Third Parties and one to unsubscribe from the Third Party whose services/products are being marketed. In this way business contacts have further control over their data processing and greater option to decide on how and when their data is used. Their information may still be used for suppression purposes i.e. to ensure that it cannot be added to the database again.
(f) Data must be processed in a manner that ensures appropriate security of the personal data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organisational measures.
Data is only used for legitimate business services that are relevant to the professional role of the data subject. Framework Marketing operates a rigorous data security environment.
(g) Individuals have the right to see, correct, restrict access to or remove their personal information.
For subject access requests, use the contact details shown above. Furthermore any direct marketing will have an “Update Your Details” option in order to easily see and correct personal information and an “Unsubscribe” option to restrict access or remove their personal information.
